Terms and Conditions
§ 1 Scope of Application
These Terms and Conditions apply to all contracts concluded between customers and The Sailing Network - Academy via this website (www.sailingnetwork.org).
§ 2 Conclusion of Contract
A booking made in written form (including email) constitutes a binding offer. We offer customers a contract based on our service description upon booking.
The contract offered through a booking only becomes binding upon acceptance by The Sailing Network - Academy as the contracting party through confirmation in written form or by email.
Contractual binding arises upon written confirmation by The Sailing Network - Academy.
§ 3 Services
The services correspond to the service description presented by The Sailing Network - Academy and sent with the booking confirmation.
Arrival and departure costs are expressly not included in our offers. Similarly, the onboard kitty (port fees, food on board, and diesel) is not included in the services and must be borne separately by the customer.
§ 4 Payments & Default
Payments are made by bank transfer after booking confirmation in written form or by email.
A deposit of 50% of the total amount is due within 14 days of booking confirmation.
The remaining payment is due 4 weeks before the start of the trip without further notice.
§ 5 Payment Default
In the event of late payment, the contract may be terminated, and The Sailing Network - Academy reserves the right to declare the booking invalid.
§ 6 Cancellation
Bookings may be cancelled at any time before the start of the program. Cancellation fees will apply in the event of withdrawal from the contract or late arrival that prevents participation in the program.
For cancellations up to 4 weeks before the start of the program, 50% of the total amount is due.
For cancellations less than 4 weeks before the start of the program, 100% of the total amount is due.
Payments made will be refunded electronically to a bank account in accordance with these terms and conditions.
The maximum refund is the amount paid, and any claim to further services or payments is generally excluded.
A booking may be transferred to another person after consultation with The Sailing Network - Academy.
§ 7 Withdrawal
The Sailing Network - Academy reserves the right to cancel programs prematurely. This occurs, for example, in the event of the skipper's absence due to illness, limitations imposed by weather conditions, or other cases of force majeure.
The Sailing Network - Academy reserves the right to withdraw from the contract up to two weeks before the start of a course if a minimum of four participants is not reached.
In the event of cancellation by The Sailing Network - Academy, we will promptly and fully refund any payments already made. No further claims exist.
The skipper appointed by The Sailing Network - Academy reserves the right to exclude participants from the course and terminate their participation due to gross negligence or disregard of safety instructions. In such cases, The Sailing Network - Academy, as the organizer, shall be held harmless.
§ 8 Right of Withdrawal
The contractual declaration can be withdrawn within 14 days without giving reasons in written form. The period for this begins after receipt of the booking confirmation. Timely dispatch of the withdrawal notice in written form is sufficient to meet the withdrawal deadline.

§ 9 Liability
Participants are liable for any property damage or personal injury caused by their gross negligence or disregard of safety instructions.
This also applies to damage to personal equipment and luggage. The Sailing Network - Academy is only liable for damage to personal luggage and equipment if caused intentionally or through gross negligence.
§ 10 Data Protection
All personal data provided for the processing of this offer is protected against misuse in accordance with the current GDPR data protection regulations.

§ 11 Choice of Law
The contractual relationship between participants and The Sailing Network - Academy is governed exclusively by German law. The place of jurisdiction is Fulda.
